3. Accounts and Eligibility
You must provide accurate and complete information when creating an account or submitting a freight request. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Our Services are intended for business use by companies and individuals engaged in international trade.
4. Quotes and Freight Requests
Freight quotes provided through our platform are estimates based on the information you provide, including origin, destination, cargo description, weight or volume, and preferred shipping mode. Quotes are subject to change based on carrier availability, market rates, accurate cargo information, and confirmation at the time of booking. A quote does not guarantee space, rate or transit time until a booking is confirmed.
5. Payments
Payment processing and related technology infrastructure for the Services are provided by Qubictron, an IT and payment processing company operating from a Dubai Free Zone. By making a payment, you also agree to Qubictron's applicable payment terms. Prices are quoted in the currency shown at checkout and may be subject to additional carrier surcharges, customs duties or taxes not included in the initial quote.
6. Shipper Responsibilities
As a shipper, you are responsible for:
- Providing accurate, complete and timely information about your cargo, including weight, dimensions and contents.
- Ensuring your goods comply with the customs, export and import regulations of the origin and destination countries.
- Properly packaging and labeling cargo in accordance with applicable shipping and safety standards.
- Providing any documentation required for customs clearance and delivery.
7. Prohibited and Restricted Cargo
You may not use our Services to ship goods that are illegal, counterfeit, hazardous without proper declaration, or otherwise prohibited or restricted by applicable law, carrier policy, or the customs regulations of the origin, transit or destination countries. We reserve the right to refuse, delay or return any shipment that we reasonably believe violates this section.
8. Carriers and Third Parties
We coordinate carriers, agents, customs brokers and other logistics providers to transport your cargo. These third parties may have their own terms, tariffs and liability limitations that apply to the portion of transportation they perform. Our role is to manage the shipment and remain your single point of contact, but certain terms of underlying carriers may also apply to your shipment.
9. Liability
To the maximum extent permitted by law, Chinese Brothers' liability for loss, damage or delay of cargo is limited in accordance with applicable international freight conventions and the terms of the carriers involved. We are not liable for delays, losses or damages caused by customs authorities, carriers, force majeure events, or inaccurate information provided by the shipper. Nothing in these Terms is intended to exclude liability that cannot be excluded under applicable law.
10. Cancellations and Delays
Bookings may be cancelled or amended subject to carrier policies, applicable fees, and the stage of the shipment process. Transit times provided by our tools are estimates; actual transit times may vary due to carrier schedules, customs processing, weather, or other factors outside our control.
11. Intellectual Property
The Chinese Brothers platform, including its tools, design, content and underlying technology, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, modify, reverse engineer or redistribute any part of the Services without our prior written consent, except as permitted through our Developer Tools and API on their own applicable terms.
12. Acceptable Use
You agree not to misuse the Services, including by attempting unauthorized access to our systems, interfering with platform functionality, submitting false shipment information, or using the Services in a way that could harm Chinese Brothers, our partners, or other users.
13. Termination
We may suspend or terminate your access to the Services if you violate these Terms, submit fraudulent information, or misuse the platform. You may stop using the Services at any time; outstanding obligations related to completed or in-progress shipments will remain in effect.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which Chinese Brothers operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Services will be resolved in accordance with that jurisdiction's applicable dispute resolution procedures.
